These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Special Care Service ("Company", "we", "us", or "our"), concerning your access to and use of the website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.
Special Care Service provides professional legal document serving (Process Server) and mobile Notary Public services. We make every reasonable effort to execute services in a timely and professional manner. However, we cannot guarantee specific outcomes in legal matters or the successful service of process if the provided target information is inaccurate, the target evades service, or other unforeseen circumstances arise.
By using the Site, you represent and warrant that: (1) all registration and order information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Service.
All payments for services are due upfront via our integrated payment processors (Stripe or Square) before the service is initiated. Due to the nature of Process Serving, attempts to serve documents incur costs and labor. Therefore, fees are generally non-refundable once attempts have been made, regardless of whether the service was ultimately successful. Refund requests for uninitiated services will be reviewed on a case-by-case basis.
Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing.
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our services, even if we have been advised of the possibility of such damages.
